CPA Secures Refund For Misled Car Buyer

MUSCAT: The Consumer Protection Authority (CPA) in Muscat has resolved a case involving a consumer who was misled during the purchase of a vehicle. The buyer had acquired the car from a dealership based on assurances that it was linked to a reputable agency, free from technical issues, and maintained according to agency-approved standards. However, the vehicle suffered a complete breakdown less than a month after purchase, prompting the buyer to file a formal complaint with the CPA. This triggered an investigation to assess the validity of the claim and ensure consumer rights were upheld.

A specialised technical inspection revealed the vehicle had sustained prior flood damage, with clear signs of rust in multiple areas, indicating long-term deterioration. These defects had been concealed at the time of sale, violating principles of transparency and fair dealing. The findings confirmed that the buyer had not been informed about the true condition and maintenance history of the car, making the dealership liable for misrepresentation. The CPA took swift action to address the breach and protect the consumer’s interests.

Following its investigation, the CPA engaged with both the buyer and the dealership to reach a resolution. This led to an amicable settlement that included the cancellation of the sales contract and a full refund of the purchase price. The resolution not only provided financial redress for the affected consumer but also reinforced the importance of fair commercial practices in Oman’s automotive sector. Such actions by the CPA aim to deter future incidents of non-disclosure and deceptive sales tactics.

The CPA has reiterated its commitment to ensuring that vehicle sellers disclose all relevant details, including accident history, damage records, and maintenance information, before completing any transaction. It warned that concealing defects infringes upon consumer rights and violates the law, potentially resulting in legal consequences for offending businesses. By continuing to monitor and follow up on similar cases, the CPA seeks to foster a transparent and trustworthy market environment, strengthening consumer confidence across the Sultanate.
